War Criminals: "Hiding in plain sight

On Thursday June 13, 2013 in an interview on IDF Radio the commander of the 53rd Battalion of the Givati Brigade, Yitzhak Pundak, confirmed that forces under his command ethnically cleansed Palestinian villages in 1948.
The following day, June 14th, the Associated Press broke a story that's spread likewildfire accusing 94 year old Ukrainian immigrant Michael Karkoc, an American citizen and Minnesota resident since 1949 of being a Nazi war criminal who commanded a unit of the Ukrainian Self Defense Legion responsible for committing atrocities during World War II.

The Associated Press has uncovered that a top commander of a Nazi SS-led unit, accused of burning villages filled with women and children, lied to American immigration officials to get into the United States.
The evidence uncovered by the news agency on Friday finds that Michael Karkoc, 94, has been living in Minnesota since shortly after World War II.
Efraim Zuroff, the director of the Simon Wiesenthal Center in Jerusalem, said that based on his decades of experience pursuing Nazi war criminals, he expects that the evidence showing Karkoc lied to American officials and that his unit carried out atrocities is strong enough for deportation and war-crimes prosecution in Germany or Poland.
“In America this is a relatively easy case: If he was the commander of a unit that carried out atrocities, that’s a no brainer,” Zuroff told AP. “Even in Germany … if the guy was the commander of the unit, then even if they can’t show he personally pulled the trigger, he bears responsibility.”

"This was a unit of volunteers, and people were volunteering ideologically not because they were Nazis but because they were Ukrainian nationalists," Ofer Ashkenazi, an expert on modern European history at Hebrew University told KARE.
Ashkenazi, who is a visiting professor at the University of Minnesota, said the Ukrainian fighters hoped to shake off Soviet oppression and sided with the Germans after being told the country would regain its autonomy.
"They formed these units under the command of the SS, or the Waffen-SS, and basically did whatever the SS wanted them to do."
The AP story maintains Karkoc eventually became an officer in the SS Galician Division, which was formed from remnants of the Self Defense Legion in the closing year of the war.
The AP's investigation found no record that Karkoc directly committed any war crimes, but said he commanded a unit that was known to massacre civilians in Poland.

I'll say. Curiously, aside from the Israel National News, there's not a peep anywhere in the  press about the Givati Brigade general's revelations on the radio Thursday. Nothing about war crimes committed during the Nakba, his justifications, his pride, or.... anything.

Why is human rights group B’Tselem "proud" to sponsor J Street gala keynoted by war criminal?

B’Tselem USA, the American arm of renowned Israeli human rights group B’Tselem is “proud” to sponsor the 26 March gala of pro-Israel lobby group J Street despite the fact that the keynote speaker is former Israeli Prime Minister Ehud Olmert.
Olmert is responsible for extensive war crimes including during Israel’s 2006 war on Lebanon and its 2008-2009 attack on the Gaza Strip.
Thousands of people were killed in the occupied Palestinian territories and Lebanon by Israeli forces during Olmert’s term of office.
Moreover, J Street itself has recently announced its “unequivocal” support for Israeli war crimes and human rights abuses – many of them condemned by B’Tselem – including the use of extrajudicial executions.
B’Tselem USA should withdraw its sponsorship of this politically biased conference whose goal is to whitewash Israeli war crimes, if it is to maintain any credibility as a human rights organization.

“Proud sponsor”

In a 15 March email to supporters soliciting donations for the organization, a copy of which was received by The Electronic Intifada, Rachel Sussman Associate Director of B’Tselem USA wrote:
B’Tselem USA is proud to be a sponsor of J Street’s third annual conference, Making History, in Washington later this month. J Street is the political home for pro-Israel, pro-peace Americans.  The conference will feature former Israeli Prime Minister Ehud Olmert, Israeli writer Amos Oz, a member of B’Tselem’s Public Council, journalist Peter Beinart, a member of B’Tselem USA’s Advisory Council and Anat Hoffman, the Executive Director of the Israel Religious Action Center.
As a sponsor of the gala B’Tselem may be contributing to Olmert’s honorarium and travel costs.
The email also announced that B’Tselem would hold a panel at the J Street conference titled “Holding Israel to a Universal Standard or to a Higher Standard on Human Rights?” from which Palestinian speakers – the main victims of Israeli human rights abuses – appear to be completely excluded.

B’Tselem on “war crimes” under Olmert in Lebanon

In a 23 July 2006 statement, B’Tselem said it was not documenting human rights violations during Israel’s massive attack on Lebanon because “B’Tselem’s mandate is limited to human rights in the West Bank and Gaza Strip.”
However, the statement observed, “Over the past week, Israel has killed hundreds of Lebanese civilians in its attacks against targets in Lebanon. There is a concern that at least some of them were disproportionate attacks, which constitute war crimes.”
During that assault Israel tested its “Dahiya doctrine” of mass destruction of civilian neighborhoods and infrastructure including roads, bridges, electricity supply and fuel reservoirs and Beirut’s international airport.
Regarding such systematic destruction, B’Tselem stated:
There is a concern that such attacks are intended to put pressure on the Lebanese Government and not to obtain a specific military advantage. If this is the case, these attacks constitute collective punishment and a grave violation of IHL [International Humanitarian Law].

B’Tselem on “war crimes” under Olmert in Gaza

Israel’s 21-day attack on Gaza beginning on 27 December 2008 did fall within B’Tselem’s mandate and the organization is unequivocal about the facts in its summary of its documentation:
Between 27 December 2008 and 18 January 2009, the Israeli military carried out an attack on the Gaza Strip, which it called Operation Cast Lead. The magnitude of the harm to the local population was unprecedented: 1,389 Palestinians were killed, 759 of whom did not take part in the hostilities. Of these, 318 were minors under age 18. More than 5,300 Palestinians were wounded, 350 of them seriously. Israel also caused enormous damage to residential dwellings, industrial buildings, agriculture and infrastructure for electricity, sanitation, water, and health, which was already on the verge of collapse prior to the operation. According to UN figures, Israel destroyed more than 3,500 residential dwellings and 20,000 people were left homeless.
The summary adds:
The extensive harm to the civilian population and the enormous damage to property do not indicate, in and of themselves, that the military breached international humanitarian law. However, investigations B’Tselem made during and after the operation, and information from many other sources, raise doubts regarding the declarations of Israeli officials that the military acted lawfully. The suspicions regarding breach of international humanitarian law relate not only to the conduct of one soldier or another, but primarily to policy.
Who was responsible for that policy? Of course the prime minister at the time Ehud Olmert. B’Tselem called for credible investigations and accountability, yet, it notes on its website:
To date, no independent investigation apparatus, empowered also to investigate the responsibility of the political and military decision-makers, has been established.
On 31 December 2008, as the bombs were falling on Gaza, B’Tselem wrote to Israel’s attorney general, naming Olmert and other officials, to protest Israel’s widespread targeting of civilian infrastructure in Gaza. “An intentional attack on a civilian target is a war crime,” the letter concluded.
But it seems such concerns are now minor for B’Tselem which is “proud” to sponsor a political conference at which Olmert is the main draw and is undoubtedly receiving a large fee for speaking. Instead, B’Tselem USA should be calling for Olmert to be arrested and tried.
J Street’s own announcement that Olmert would address its “gala,” makes no mention of Gaza or Lebanon and speaks of Olmert in laudatory terms, whitewashing the crimes that B’Tselem’s mandate is to investigate and document.

J Street’s support for human rights abuses

B’Tselem, along with many other local and international human rights groups, has condemned Israel’s policy of extrajudicial execution of Palestinians Israel accuses of “masterminding” attacks.
In a 2001 position paper, B’Tselem detailed the criminality of this policy both in terms of Israeli and international law.
Yet J Street had no such concerns. In an 11 March statement, the group declared:
We condemn the rocket fire on Israel and unequivocally support Israel’s right to protect its citizens from attack.
The statement made no mention whatsoever of Israeli attacks on Palestinians, including the extrajudicial killing that set off the escalation.
A 12 March statement said “J Street staunchly supports Israel’s right to defend and protect its citizens, and this includes acting to thwart terrorists planning or executing attacks.”
In other words J Street doubled down on its support for the Israeli assault on Gaza, and apparently gave direct support to the policy of extrajudicial execution of Palestinians sentenced to death by Israel in secret and in absentia.
That B’Tselem could call itself a “human rights group” and sponsor a gala for Olmert but also with J Street and its effort to whitewash war criminals and their crimes should not be a cause for pride but for utter shame.

Spain says it cannot offer War Criminal Dichter immunity against arrest

MADRID, (PIC)-- Spanish authorities said it cannot grant former head of the Israeli Shin Bet Avi Dichter immunity from arrest and interrogation if he intends to visit its territories because of an arrest warrant issued against him.
Dichter was intending to travel to Madrid to attend a summit between officials from the Palestinian authority and Israel, but he cancelled his participation in the event for fear of arrest.
Spanish and Palestinian human rights organizations filed a lawsuit against a number of Israeli officials, including Dichter, with Spanish courts for their involvement in war crimes committed in 2002 in Al-Daraj neighborhood in the Gaza Strip which led to the death of 14 civilians including nine children and the injury of many others.
The Palestinian center for human rights hailed Spain for taking such step, saying it affirmed that its territories cannot be a safe haven for war criminals even if they enjoy diplomatic immunity.
The center urged Spain to abolish the recent amendments it made to the law of international jurisdiction, asserting that such amendments are against the international obligations laid over the shoulder of Spain.

Austria: Genocide Charges against Ehud Barak

Ehud Barak Yesterday, at almost the same time when Ehud Barak was being given military honors at the defense ministry, genocide charges against him were being presented at the office of the Austrian prosecutor, only about 15 minutes walking away.

The charges relate entirely to the Gaza massacre committed between December 2008 and January 2009 by Israeli troops under the command of Ehud Barak, and the whole allegation of crimes in the letter to the prosecutor consists of the so-called “Goldstone Report” itself, and it names as witnesses the members of the commission, judge Goldstone and his colleagues, as well as their interview partners.

At the time when these charges were being presented, the news that an arrest warrant had been issued against Tzipi Livni in the UK had not yet transcended; this only became known in the evening hours, and as of today 15 December, it appears that the Austrian authorities have not taken action against Barak. This could have different grounds. First, the situation of Livni and Barak are different: whereas Livni currently has no function in government, Barak is currently defense minister and vice-premier; secondly, Austria is still apprehended in the notion that they have a political and moral duty to ensure the security of Israel, whatever Israel does and probably at any cost to Austria, because of understandable yet irrelevant historical facts, third, England has implemented the Rome Statute of the ICC as a national law, whereas this is not the case in Austria yet. Ultimately the main reason why Austria has not taken action in this case might be the almost absence of public discourse around the crimes of Israel, a situation which will most probably evolve to the better.

At the same time, the governments who still support “negotiations” or a “two-state solution” should disabuse themselves of the notion that Israel, with its genocidal and racist to the extreme posture is in any way a partner for negotiations of any kind, be this with us Palestinians or any other party. The experience of over 60 years of occupation has shown that Israel consistently conducts all negotiations in bad faith, and that speaking with them is a fruitless endeavour. It is time for other approaches in order to solve the problems which they have caused during the last 6 or 7 decades.

I see the arrest warrant against Livni as a first step in the right direction, and would very much greet that in the future the discussion around Israel and its unrelenting criminality was less based on misguided notions of “moral duty” and much more on enacted national and international laws, which is what makes out states of law everywhere.

Former Israeli FM Tzipi Livni Will Be Arrested If Enters UK

Arab and Israeli media sources reported Monday that a British court has issued an arrest warrant against former Israeli Foreign Minister Tzipi Livni for her role in orchestrating last winter's offensive against Gaza.



Arab and Israeli media sources reported Monday that a British court has issued an arrest warrant against former Israeli Foreign Minister Tzipi Livni for her role in orchestrating last winter's offensive against Gaza.


Livni canceled her participation in a Jewish function in the UK, after receiving information from Scotland Yard that a warrant for her arrest had been issued.

Livni's office dismissed reports that the trip was cancelled over this warrant, adding that Livni spoke to the conference through the video conferencing technology as planned.

Some Palestinian solidarity groups in the UK have been following up on the war on Gaza and filed lawsuit against Israeli leaders accusing them of war crimes, which would subject any Israeli senior official for arrest in certain European countries.

The Israeli war on Gaza December 08 – January 09 claimed the lives of around 1500 Palestinians, over 5000 wounded and over 13 Israeli dead soldiers in addition to huge damage of the infrastructure of the coastal region.

Livni, a long term right winger, lost the Prime Minister elections to Benjamin Netanyahu. Livni is the leader of Kadima, a party formed by former Israeli Prime Minister Ariel Sharon and led by senior leaders from Labor, such as Shimon Peres and Ehud Olmert from Likud and Sharon himself before he enters a long coma which he is not expected to recover from. Kadima is recognized as centrist in the Israeli political spectrum and was the party that led the devastating war against the Gaza Strip.

America's Most Wanted - The Top 50 US War Criminals

"After Downing Street" -- Compiled below, in hopes that it may be of some assistance to Eric Holder, John Conyers, Patrick Leahy, active citizens, foreign courts, the International Criminal Court, law firms preparing civil suits, and local or state prosecutors with decency and nerve is a list of 50 top living U.S. war criminals. These are men and women who helped to launch wars of aggression or who have been complicit in lesser war crimes. These are not the lowest-ranking employees or troops who managed to stray from official criminal policies. These are the makers of those policies.

The occupations of Iraq and Afghanistan have seen the United States target civilians, journalists, hospitals, and ambulances, use antipersonnel weapons including cluster bombs in densely settled urban areas, use white phosphorous as a weapon, use depleted uranium weapons, employ a new version of napalm found in Mark 77 firebombs, engage in collective punishment of Iraqi civilian populations -- including by blocking roads, cutting electricity and water, destroying fuel stations, planting bombs in farm fields, demolishing houses, and plowing down orchards -- detain people without charge or legal process without the rights of prisoners of war, imprison children, torture, and murder.

The list below does not include those responsible for war crimes prior to 2001. Nor does it include those currently in power who are making themselves complicit by failing to prosecute or cease commission of these crimes. The list could be greatly expanded. It could also be narrowed. I would argue, however, that it presents a more reasonable starting place than Holder's reported proposal to investigate only CIA employees who failed to comply with criminal torture policies, of whom there are no doubt more than 50.

CALIFORNIA

1. John Yoo: Professor of Law at Boalt Hall School of Law in Berkeley, California, with house at 1241 Grizzly Peak Blvd., Berkeley, (but a lawyer with the Pennsylvania bar from which he should be disbarred and would be if enough people demanded it ) counseled the White House on how to get away with war crimes, wrote this memo promoting presidential power to launch aggressive war, and claimed the power to decree that the federal statutes against torture, assault, maiming, and stalking do not apply to the military in the conduct of the war, and to announce a new definition of torture limiting it to acts causing intense pain or suffering equivalent to pain associated with serious physical injury so severe that death, organ failure or permanent damage resulting in loss of significant body functions will likely result. Yoo claimed in 2005 that a president has the right to enhance an interrogation by crushing the testicles of someone's child . Yoo has been confronted in his classroom: video , and defended by the Washington Post , and again confronted in the classroom .

He suggested that Bush declare that the Taliban and Al Qaeda weren't covered by Geneva, to be on the safe side. Bush did so. Gonzo now has a job at Texas Tech , but not teaching law. Even while Addington, Gonzales and the lawyers were beginning to build the legal framework for torture, a couple of military psychologists were laying out the techniques the military would use. James Mitchell, a retired military psychologist, had been a leading expert in the military's SERE program. In December 2001, with his partner, Bruce Jessen , Mitchell reverse-engineered SERE techniques to be used to interrogate detainees. Then, in the spring of 2002, before OLC gave official legal approval to torture, Mitchell oversaw Abu Zubaydah's interrogation. An FBI agent on the scene describes Mitchell overseeing the use of "borderline torture." And after OLC approved waterboarding, Mitchell oversaw its use in ways that exceeded the guidelines in the OLC memo. Under Mitchell's guidance, interrogators used the waterboard with "far greater frequency than initially indicated" -- a total of 183 times in a month for Khalid Sheikh Mohammed and 83 times in a month for Abu Zubaydah.

No Justice, No Peace

Judge's comment on Rove's citizen arrest in Iowa: "It's about time."

We encourage you to nonviolently protest these people and insist that they be given what so many of them have denied others: a fair trial. We encourage you to attempt to make citizen's arrests, after consulting lawyers and learning how to avoid any unnecessary criminal risk to yourselves. It is possible to confront a war criminal at a public event and announce a "citizen's arrest!" without actually touching (or handcuffing) the criminal.

You may want to avoid announcing that you're coming , because the war criminal may choose to escape .

Your team should include one or more people who can produce an excellent video and be extremely fast in editing and posting it online. Your team should ideally include a lawyer. And, of course, people who can read the charges and question the suspect. Everyone on your team should be able to keep a secret while you're planning your arrest or protest.

Read the war criminal their rights, rights they have denied others:
"You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to have an attorney present during questioning. If you cannot afford an attorney, one will be appointed for you."

Read the war criminal the charges against them.

Ask the war criminal if they would like to say anything.

Once you have good video footage, your top priority becomes immediately getting it edited (if necessary) and online.

If possible, turn the war criminal over to the police.

Pass out flyers to passersby.

Send statement to the media and/or have the media present.

Consult a lawyer to avoid unnecessary risks of violating laws while enforcing the law. According to Wikipedia , "A citizen's arrest is an arrest made by a person who is not a sworn law enforcement official. In common law jurisdictions, the practice dates back to medieval England and the English common law, when sheriffs encouraged ordinary citizens to help apprehend law breakers. Despite the title, the arresting person does not usually have to be a citizen of the country where he is acting, as they are usually designated as any person with arrest powers.... Each state with the exception of North Carolina permits citizen arrests if the commission of felony is witnessed by the arresting citizen... The application of state laws varies widely with respect to ... felonies not witnessed by the arresting party. American citizens do not carry the authority or enjoy the legal protections of police, and are held to the principle of strict liability before the courts of civil- and criminal law including but not limited to any infringement of another's rights. Though North Carolina General Statutes have no provision for citizen's arrests, detention by private persons is permitted and apply to both civilians and police officers outside their jurisdiction. Detention, being different from an arrest in the fact that a detainee may not be transported without consent, is permitted where probable cause exists that one has committed a felony, breach of peace, physical injury to another person, or theft or destruction of property ... A person who makes a citizen's arrest could risk exposing himself to possible lawsuits or criminal charges (such as charges of impersonating police, false imprisonment, kidnapping, or wrongful arrest) if the wrong person is apprehended or a suspect's civil rights are violated." In the case of the war criminals we propose detaining, they are most if not all public figures and we have all witnessed their felonies, as detailed above.
