First lawsuit against Israeli soldiers in Spain.

Antonio Segura, Gonzalo Boye, Raul Maillo,
Juan Moreno,Lawyer have a long experience in cases
concerning International Law and Humanitarian Law.

These lawyers are very known in Spain because of their
fight for human rights in Universal Jurisdiction.
The most known case was the one of Pinochet, who was
held in Great Britain for more than one year. Also they represented victims of torture in Guatemala; the case
of Jose Couso, the Spanish camera that was killed by
American soldiers in Bagdad, and many others like
Scilingo case or the bombing in Madrid 11M.
Their commitment with the victims around the world
make them being very known by human rights and
solidarity groups. Jointly with Palestinian Centre
for Human Righs, in behalf of it his Director
Raji Sourani, this lawsuit is the first in Spain and
several Human rights Associations have been
working together with the group of Lawyers for
more than two years now. After a long wait, the
24th of June was presented in the Audiencia Nacional
(National Courts) and we wait to see that justice and
moral compensation come to the victims, while the
perpetrators of such a crime are held to the justice.
The Spanish civil society (with groups like Arab Cause
Solidarity Committee and Al-Quds Asociation for
Solidarity with People in Arab Countries and many
others) jointly with other groups around the world
are working to make justice in Palestine, while, at the
same time, the governments leave aside their
obligations and act in an immoral and non political
way just trying to compensate economically the
Palestinians, without any considerations of their
political and international commitments. We are
happy to say that Spain join the group of countries,
whose tribunal had accepted cases against Israeli
militars, as Great Britain, Switzerland, Netherland,
United States or New Zealand. And we hope justice
to be make with the victims.

First lawsuit against Israeli soldiers in Spain.

Six survivors together with relatives of the victims
caused by a bomb launched by the Israeli Army
on July 22, 2002 against Gaza, will bring a lawsuit
in the Audiencia Nacional (National Court). Although
this is not the first time people have asked this Court
to deal with crimes against humanity, it is the first
time that the victims of an Israeli targeted attack
in the Palestinian territories have asked the Court
by themselves.

The lawsuit, 35 pages long, explains in detail why these events should be considered war crimes subject to universal jurisdiction: the attack was disproportionate.

One target: fifteen casualties.

Around midnight, an Israeli war plane launched a one ton bomb over the Gaza neighbourhood of Al Daraj. The target was Salah Shehadeh, a suspect HAMAS commander. The bomb destroyed his house and seven more at the same time. Thirty more people were also affected, fifteen died and one hundred and fifty sustained injuries of various degrees.

The lawsuit is against the Israeli Defence Minister, Benjamin Be-Eliezer, and six people under his orders.

The victims were told by an Israeli court that the attack was proportionate.

However, the international community considered it illegal and disproportionate, especially taking into account the sophisticated Israeli military technology.

Israeli Human Rights Violations in the Occupied Palestinian Territory The Past Week

Between September 6 and 12, 2007. During this period, Israeli troops shot and killed six Palestinians, including two children, and injured 23 including nine children. Israeli troops carried out no less then 35 invasions in the occupied West Bank and three in the Gaza Strip. During these attacks, 54 Palestinians were kidnapped in the West Bank and six in the Gaza Strip.
Israeli violations in the West Bank:

Back in June 9, in the northern West Bank city of Jenin, soldiers opened fire at a group of Palestinian children who hurled stones at the invading forces. Two children were injured in the invasion and one of them died of his wounds on September 10.

During September 6 and September 12 Israeli troops carried out no less then 35 invasions in several West Bank cities, towns and refugee camps. The attacks included breaking into homes and firing rounds of live ammunition.

Soldiers took prisoner 54 residents, including three children, and the wife of a resident who is wanted by the Israeli security.

At least three residents were also taken prisoner on roadblocks installed by the army in several West Bank areas. One resident was kidnapped at a military roadblock, near Nablus in the northern part of the West Bank; the army claimed that he carried explosives but that has been unconfirmed to date, and a Palestinian policeman was also arrested at an Israeli roadblock near the northern West Bank city of Tulkarem.

On Wednesday morning, the Israeli authorities imposed a strict siege over the occupied territories as Israeli celebrates a Jewish feast. The siege will continue until Sunday September 16.

This siege added more hardships to the residents who are already living under severe restrictions of their movement.

The Israeli Authorities and the army issued a military order closing the Ibrahimi Mosque, in Hebron, for 5 separate days during the holy Ramadan Month, allegedly to allow Jewish settlers to celebrate Jewish feasts.

The mosque will be cloed to Muslims on 13, 19, 22 and 30 September and 1 October 2007 during the holy Muslim Ramadan Month, in order to allow Jewish settlers to celebrate Jewish occasions.

Attacks against nonviolent Wall protests:

Troops continued their attacks against Palestinian and international peace activists peacefully protesting against the Annexation Wall in the West Bank.

The attacks were carried out against peaceful protesters in Um Salmouna village, near Bethlehem, and Bil'in village, near Ramallah.

On Friday August 31, soldiers attacked Palestinian civilians, Israeli and international peace activists peacefully protesting against the Annexation Wall in Bil'in. soldiers placed barbed-wires and fired tear gas, rubber-coated bullets and round bombs.

Soldiers also violently attacked and clubbed several protesters. A 42-yeard old woman was injured when a tear gas canister hit her in the leg, while several protesters suffered from tear gas inhalation.

Settler attacks:

On September 11, settlers of the illegal Abraham Abino outpost, in the Old City of Hebron, occupied the rooftop of the Al Aqtab mosque, and started building on it to expand their illegal outpost, the army was present in the area and provided protection for the settlers instead of stopping them.

Jerusalem:

Israeli soldiers and police men broke into the headquarters of the local council of Bir Nibala village, northwest of Jerusalem and confiscated three computers and official documents.

Jerusalem remained isolated from the rest of the West Bank and further restrictions were enforced due to celebrations of Jewish feasts.

A full siege was imposed over all of the occupied territories, which also includes sealing different Palestinian areas from each other.

The siege was imposed on September 12 and will remained in place until September 16.

Israeli violations in the Gaza Strip:

On September 6, soldiers killed three Palestinian members of the resistance after firing a tank shell at a group of fighters in Al Qarara village, northeast of Khan Younis, in the southern part of the Gaza Strip. Three more fighters, and ten residents, were injured.

A fourth fighter was killed during clashes with the invading forces.

5 family members, including 3 children and a woman, were wounded when the army fired a missile at the apartment building where they live. A total of ten residents were injured.

Troops, using military bulldozers, uprooted 66 Dunams of agricultural land.

During the invasion, troops detained 150 civilians for several hours, and released them all except for two brothers who were transferred to an unknown destination.

On September 8, soldiers fired at Palestinian children, hunting birds in an area close to the border between the Gaza Strip and Israel; one child was killed. The children were hunting in an open area, and did not carry any firearms.

All borders crossings in the Gaza Strip remained closed, thus causing further deterioration of the economic condition of the resident.

The siege imposed on the Gaza Strip has severely impacted the flow of food, medical supplies and other necessities such as fuel, construction materials and raw materials for various economic sectors.

Hebron – Israeli settlers set fire to a Palestinian mosque in the old city of Hebron on Tuesday morning and prevented the fire services from reaching the blaze.

Ma'an's correspondent reported that one fire fighter said "we heard the settlers taunting the Palestinians through the telephone when the people in the mosque made distress calls to us. The Palestinians also called for the Israeli soldiers to help to stop the attack on the mosque."

Sources from the fire services department in the old city told Ma'an that they received a telephone call from Israeli officials requesting that they go and extinguish the fire in the mosque.

A source from the fire services said "when we reached the area we were met by dozens of Israeli settlers who attacked us with stones and rocks."

The source added that the settlers prevented the Palestinian fire services from extinguishing the fire and that the Israeli soldiers refused to intervene to end the assault.

Eviction order

Fierce clashes erupted between Israeli soldiers and settlers on Tuesday after the Israeli forces attempted to evict the settlers from shops in old vegetable market in the southern West Bank city of Hebron.

The shops were occupied by the settlers six years ago.

Ma'an's correspondent reported that around a thousand Israeli soldiers and police attempted to break into the shops while the settlers were inside. The settlers retaliated by throwing stones and rocks, and throwing coloured dye and diesel on the soldiers.

The fighting resulted in the injury of a number of soldiers and settlers.

Two settler families, which seized the shops six years ago, are subject to an Israeli Supreme Court order for their eviction after an appeal made by Hebron municipality.

In recent days settlers have increased their attacks on the Palestinian citizens of Hebron
.
